As we start 2010, this is a brief round-up of happenings and forthcoming events - this website runs with the assistance of Gifford Community Council whose help is greatly appreciated; regular updates of council meetings and other items of news will appear here.

Drinks Ban Consultation

After much discussion, Gifford Community Council wishes to further investigate the views of those living in the Community Council Area before making a decision on whether to ask East Lothian Council to impose a ban on drinking in public places in Gifford. 

A consultation paper is included with the edition of the Gifford Newsletter being distributed in early December 2009, and you are asked to let the Community Council have the opinions of those aged 18 years or more living in your household, by filling in the number who are “FOR” a ban, and the number “AGAINST”; please then tear off the slip and put it in the Ballot Box in 1st Kilts in Main Street, Gifford by 4 pm on 20 February 2010.   Only returns on the properly authenticated tear-off voting slip delivered with the Gifford Newsletter will be counted.

The presumption is that such a ban would apply in public places throughout the built-up area of Gifford itself—that is, any place to which the public has access, such as the streets and roads and public green areas such as the Bleachfield, and areas such as the Nursery between the Bleachfield and the Edinburgh Road, and the cricket field, but not, of course, within licensed premises or private premises. It would not apply on Gala Days.

In line with similar Byelaws presently in place in some towns and villages in East Lothian an offence would be defined in the following terms:

(1)  Any person who consumes alcoholic liquor in a designated place or is found to be in possession of an open container containing alcoholic liquor in a designated place in circumstances whereby it is reasonable to infer that that person intended to drink from it whilst in a designated place shall be guilty of an offence and liable on  summary conviction to a fine not exceeding level 2 on the standard scale. (Currently £500).

(2)  It shall not be an offence against these Byelaws to do anything in any designated place which is a licensed canteen, licensed premises or a registered club.

(3)  It shall not be an offence against these Byelaws to do anything in any designated place in respect of which there is in operation:

            (a) an occasional licence in terms of Section 33(1) or (2) of the Licensing (Scotland)

     Act 1976, or

(b) an occasional permission in terms of Section 34(1) of that Act,

during any period when alcoholic liquor may be sold there by virtue of that licence or, as the case may be, permission and for 15 minutes after the expiry of such period.

The possible Drinks Ban will be discussed and debated at a Special Meeting of Gifford Community Council at 7.30 pm on Tuesday 9 February 2010, in the Main Hall of the Village Hall, when there will be plenty of opportunity to ask questions, and state points of view.  ALL WELCOME. If you are unable to attend but wish to record an opinion, please write to the Community Council.

At 4 pm on Saturday 20 February 2010 the Ballot Box will be taken to the Main Hall of Gifford Village Hall, where the count will be conducted in public and the result declared.  The Community Council will make its decision at its meeting on 8 March 2010. ALL WELCOME.
